Privacy Policy

The following forms the privacy policy (‘the Policy’) governing the collection, use and disclosure of personal information of people and organisations with whom the Company deals. 

This Policy is provided to you by Omega Ensemble (‘the Company’), Level 5, 757 Elizabeth Street, Zetland NSW 2017, ABN 40 120 304 725  ('we' or 'us').

Although not legally obliged to do so under the turnover exemption of the Privacy Act 1988 (Cth), the Company complies with the requirements of the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth).

Information we collect

The Company only collects personal information that is necessary for and in the process of the performance of its functions. Personal information which is collected as an incident of a business relationship between the Company and an individual (or the organisation they work for) which may be held by us may include:

  • Your name and contact details (and the name and contact details of any organisation for which you work);

  • Communications, including but not limited to emails, letters and records of phone conversations between the Company and you, and between the Company and any organisations for which you work.

Occasionally, the Company may collect personal information about individuals in their private capacities, for example where an individual:

  • Registers for an event, or makes a ticket purchase to an event or enquires regarding making a purchase to an event;

  • Opts in to a marketing list (including email or SMS) to receive notifications or promotions from the Company;

  • Applies to or registers for a program administered by the Company;

Personal information collected about individuals in their private capacities includes but is not limited to your name, email address, home address, telephone number, gender and age. This information is only collected by the Company when you voluntarily give it to us; however this information may be necessary in order for the Company to provide services or products to you.

The Company does not use ‘cookies’ or other means to collect personal information about people who access our websites.

The Company’s internet server may automatically record details about any computer used to access the websites, such as: the IP address, domain name and browser type; the date and time of access; and details of the information downloaded. This information is used only for internal statistical purposes and to improve the functioning of our websites and does not include personal information.

The Company does not collect and hold sensitive information (such as information about racial or ethnic origin, political activities or affiliations, memberships of unions or other associations, religion, sexual preferences or practices, criminal record or medical history) without your consent. Where you provide such information to us voluntarily, this information will be held or disclosed in accordance with the APPs.

Use of personal information

Any personal information that the Company collects about you will be used only in the process of providing you with the services you have requested or to enable us to carry out our business functions. We may also use your personal information to inform you of both relevant services offered by us and information pertinent to your purchase, attendance or involvement in an event conducted of the Company. 

If at any stage you do not wish to receive this type of information, simply reply to the email and request to be unsubscribed. We will use reasonable endeavours to remove your personal information within a reasonable period of receipt of your request.

Storage and security of your personal information

The Company will use all reasonable endeavours to maintain the security of your personal information and to protect your personal information from misuse, interference and loss and against unauthorised access, modification or disclosure. The Company will destroy any personal information it holds about you which it no longer requires under the terms of this Policy.

Due to the nature of the Internet, the Company does not provide any guarantee or warranty regarding the security of your personal information during transmission to us or storage by us and you acknowledge that you disclose your personal information to us at your own risk. 

Please contact us immediately if you become aware or have reason to believe there has been any unauthorised use of your personal information in connection with the Company.

Disclosure of personal information

The Company generally only discloses personal information to other persons or organisations for the primary purpose for which we have collected it, or with your consent (which may be explicit, or may be implied from your conduct or from the circumstances in which the information is collected). 

We may also disclose personal information if we are required or permitted by law to do so (e.g. under the APPs), if it is reasonably necessary in the Company’s opinion to protect the rights or property of the Company or any third party, or to avoid injury to any person.

The following sections describe some of the organisations, or types of organisations, to which the Company usually discloses personal information and you consent to disclosure in this manner by the Company. 

Wherever personal information is disclosed outside of the Company, we take reasonable steps to ensure that the recipient:

  • handles that information in accordance with the APPs;

  • only uses the information for the specific purpose(s) for which it is provided to them;

  • does not disclose the information to any person or organisation except in accordance with directions from the Company; and

  • stores the information securely, and either destroys it or returns it to the Company when it is no longer needed.

Disclosures to contractors and service providers

The Company may rely on third party contractors or organisations to provide services or perform functions on our behalf, and this may involve a disclosure of personal information by the Company to that third party. 

While these vary from time to time, the Company may disclose your personal information, and you consent to the disclosure of your personal information, to:

  • organisations that provide communication services on our behalf;

  • legal advisors; and

  • information technology service providers.

Disclosure to government agencies

Under Funding Agreements with state and federal government agencies, the Company may be required to disclose personal information to the government agency or their related third parties (such as an independent evaluation consultant). 

Disclosure to overseas recipients

Information collected by the Company is sometimes disclosed to overseas recipients (and in respect of such recipients you consent to such disclosure and acknowledge and agree that subclause 8.1 of the AAPs will not apply).

Accessing and correcting personal information

The Company will use all reasonable endeavours to keep personal information it holds accurate, complete, up-to-date, relevant and not misleading. 

Please contact us if you would like to access the personal information the Company holds about you. In all cases except those specified by law, you can gain access to personal information we hold about you. If we refuse to give you access, we will provide you with reasons for our refusal. 

You also have the right to ask us to correct personal information about you that you believe is inaccurate, incomplete or out of date or to request that your personal information be deleted. If you wish to exercise these rights, we ask that you make a request in writing to our Privacy Officer (see below). 

You will need to provide some form of identification (e.g. a copy of your driver's license or passport) so we can verify that you are the individual to whom the personal information relates. You should also include details of how we can contact you in case we need to discuss your request. We will respond to requests for access and changes to personal information as quickly as practicable. If applicable, any legal requirement on us to maintain certain records of your personal information shall prevail over any of your requests.

Applicable law

The Company’s websites are controlled by the Company from its office in Australia. Those who choose to access the websites from locations outside Australia do so at their own risk and are responsible for compliance with local laws. This Policy will be governed by and construed in accordance with the laws of Australia. If any provision of this Policy is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of this Policy which will continue in full force and effect.

The Company reserves its right to change its Policy at any time. Notification of any such changes shall be made by posting the updated version on our websites.
